Jammu and Kashmir Put Under President’s Rule

Jammu and Kashmir was placed under President’s Rule on Wednesday, with the Central government deciding on the move following the expiry of six months of Governor’s Rule in the state. Governor’s Rule completed six months in Jammu and Kashmir today.

The recommendation for the imposition of President’s Rule in J&K was given by state Governor Satya Pal Malik, who had sent a report to the Centre. The proposal to impose President’s Rule in J&K was approved by the Union Cabinet.

Today, Rashtrapati Bhavan issued a proclamation in the name of President Ram Nath Kovind declaring that the state Assembly’s powers shall be exercisable by or under the authority of Parliament.

In June, the state was put under Governor’s Rule after the PDP-BJP coalition government collapsed. The BJP had withdrawn support to the Mehbooba Mufti government over growing incidents of terrorism and stone-pelting.

The state of Jammu and Kashmir has a separate Constitution and six months of Governor’s Rule is first imposed under Article 92. During these six months, all the powers of the Legislature come under the purview of the Governor.

After the expiry of six months of Governor’s Rule, the Legislative Assembly is dissolved following which the President’s Rule is imposed for six months. If elections are still not called after the expiry of the President’s Rule, the same can be extended by another six months.

Governor Malik had on November 21 dissolved the 87-member state Assembly after the PDP, the Congress and the National Conference came together to stake claim to form the government. Two-member People’s Conference, of Sajjad Lone, also staked a counter claim saying he had support of 25 BJP MLAs and 18 other unknown members.
